1. GENERAL AGREEMENT
Welcome to Everlastingmems.com. Our website and all use of it are governed by the following Terms of Service ("TOS"). You agree that Everlastingmems.com is not liable for any loss or damage arising from your failure to comply with the TOS. You further agree that Everlastingmems.com shall have the right to alter or amend the TOS or any other guidelines or policies at any time, with or without advance notice to you.

7. STORAGE
You acknowledge that Everlastingmems.com may establish general practices and limits concerning use of the Service, including without limitation the number of days that memorial postings or other uploaded Content will be retained, the size of any message that may be posted, the disk space that will be allotted on Everlastingmems.com 's servers on your behalf, and the amount of time during which you may access the Service.

You agree that any termination of your access to the Service under any provision of this TOS may be effected without prior notice, and acknowledge and agree that Everlastingmems.com may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. You further agree that Everlastingmems.com shall not be liable to you or any third-party for any termination of your access to the Service pursuant to this Section.
10. ADVERTISERS
Your communication and interaction with advertisers found on or through the Service are solely between you and such advertiser. You agree that Everlastingmems.com is not liable for any loss or damage of any sort incurred as the result of the acts or omissions of such advertisers.
11. LINKS
The Service may provide, or third parties may provide, links to other World Wide websites or resources. You acknowledge and agree that Everlastingmems.com has no control over such sites and resources and is not responsible for the availability or Content of such external sites or resources. - Everlastingmems.com MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, OR (iv) ANY ERRORS IN THE SERVICE WILL BE CORRECTED.
- ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA RESULTING FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

13. LIMITATION OF LIABILITY
You understand and agree that Everlastingmems.com is not liable for any direct, indirect, incidental, special, consequential or exemplary damages (even if Everlastingmems.com has been advised of the possibility of such damages) resulting from:
(i) your use or inability to use the Service;
(ii) unauthorized access to or alteration of your transmissions or data;
(iii) statements or conduct of any third party on the Service; or
(iv) any other matter relating to the Service.
14. EXCLUSIONS AND LIMITATIONS
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations of Sections 12 and 13 may not apply to you.
15. INDEMNITY
You agree to indemnify, defend, and hold Everlastingmems.com, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim, demand or loss made by any third party due to or arising out of Content you submit, post, transmit or make available through the Service, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of the rights of any other person or entity.
16. GENERAL INFORMATION
The TOS, your Service Agreement, and the relationship between you and Everlastingmems.com shall be governed by the laws of the State of New York without regard to its conflict of law provisions. The failure of Everlastingmems.com to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. If any provision of the TOS is found by a court of competent jurisdiction to be invalid, the parties agree that the court should try to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect.
